1. Scope and contracting party

1.1 These General Terms and Conditions (Terms) apply to all orders you place with us through our online shop at theralpine.com or by other means (for example by e-mail or quote).

1.2 Your contracting party depends on the delivery country:

  • Delivery to Switzerland or Liechtenstein: Theralpine AG, Wolleraustrasse 41a, 8807 Freienbach, Switzerland, registered in the commercial register of the Canton of Schwyz, UID/VAT no. CHE-153.158.189 MWST, e-mail hello@theralpine.com.
  • Delivery to all other countries: THERALPINE LLP, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, registered at Companies House (England and Wales) under no. OC456672, VAT ID PL5263807180, e-mail hello@theralpine.com.

In these Terms, "we" and "us" refer to your contracting party under clause 1.2. Your order confirmation also shows which company is your contracting party.

1.3 A consumer is any natural person who concludes a contract for purposes that are predominantly outside their trade, business or profession. A business customer is any person or company acting in the exercise of their trade, business or profession when concluding the contract.

1.4 Deviating terms of the customer do not apply unless we expressly agree to them in writing.

2. Conclusion of the contract

2.1 The presentation of our products in the online shop is not a legally binding offer but an invitation to place an order.

2.2 You can add products to the cart and enter your contact, delivery and billing details as well as the shipping and payment method at checkout. Before submitting the order, you see an overview of all details and can correct input errors at any time. By clicking the order button, you submit a binding offer to purchase the products in your cart.

2.3 The contract is concluded when we accept your order with an order confirmation by e-mail. You receive the order confirmation automatically immediately after completing checkout. For quote orders paid in advance by bank transfer, we accept your order within five business days; otherwise you are no longer bound by it.

2.4 In the event of obvious pricing, typing or calculation errors in our online shop, we are entitled to contest our acceptance in accordance with the statutory provisions; we will then refund any payments already made without undue delay.

2.5 The contract languages are German and English. We store the contract text. With the order confirmation, you receive by e-mail your order details, these Terms and the withdrawal instructions with the model withdrawal form. Please keep these documents. You may save and print our contractual and legal documents for your own records.

3. Prices and shipping costs

3.1 For deliveries to Switzerland and Liechtenstein, prices are in Swiss francs (CHF) including Swiss VAT. For deliveries to EU countries, prices are in euros (EUR) including statutory VAT. For other countries, the prices and currencies shown at checkout apply.

3.2 Shipping costs are set out in our shipping policy and are shown to you at checkout before you submit your order. For deliveries to the United Kingdom, Norway and other countries outside the EU, Switzerland and Liechtenstein, import VAT, customs duties and clearance fees may additionally apply. They are not included in the price and are payable by you to customs or the carrier.

4. Payment

4.1 The payment methods shown at checkout are available, for example credit and debit cards, Apple Pay, Google Pay, Shop Pay, Klarna and, in Switzerland, TWINT. For payments via Klarna, Klarna's terms also apply.

4.2 The purchase price is due upon conclusion of the contract. For payment in advance (bank transfer), we ship the goods after receipt of payment.

4.3 If you have questions or problems with a payment, please contact us first before initiating a chargeback. We may charge you the costs we incur as a result of an unjustified chargeback.

5. Delivery

5.1 We deliver to the countries listed in our shipping policy. The delivery time is stated on the product page or in our shipping policy. If a product is marked as available for pre-order or with a longer delivery time, the delivery time stated there applies.

5.2 Delivery is made curbside. Please make sure the delivery address is accessible to the carrier and that someone can accept the delivery. If the delivery cannot be completed for reasons for which you are responsible, we may charge the costs of further delivery attempts.

5.3 If an ordered product is unexpectedly unavailable because, despite a matching purchase contract concluded in good time, our supplier fails to deliver to us through no fault of our own, we will inform you without undue delay. You may then withdraw from the contract; we will refund any payments already made without undue delay. Your statutory rights remain unaffected.

5.4 If delivery is delayed by force majeure or other unforeseeable events for which we are not responsible (for example natural events, strikes, official measures or disruptions at carriers and customs), the delivery time is extended by the duration of the impediment. We will inform you without undue delay. If the impediment lasts longer than two months, both you and we may withdraw from the contract; we will then refund any payments already made without undue delay.

5.5 Information on cooling times, achievable water temperatures and energy consumption refers to the stated measurement conditions, for example water volume, ambient temperature and cover. In operation, these values depend on location, sun exposure, ambient temperature, water volume and use.

6. Retention of title

The goods remain our property until paid in full. For contracts with Theralpine AG, an effective retention of title requires the register entry under Art. 715 of the Swiss Civil Code.

7. Right of withdrawal and returns

7.1 Consumers with delivery to the European Economic Area (EU, Iceland, Liechtenstein, Norway) or the United Kingdom have a statutory right of withdrawal. The details and the model withdrawal form are set out in our withdrawal instructions on theralpine.com.

7.2 Swiss law does not provide a general statutory right of withdrawal for online purchases. Theralpine AG voluntarily grants consumers with delivery to Switzerland a 14 day return right under our return policy. For deliveries to other countries, statutory withdrawal rights depend on the applicable law; where none exists, our voluntary return right applies.

7.3 Business customers have no right of withdrawal or voluntary return unless expressly agreed otherwise.

8. Transport damage

Please inspect the delivery upon receipt and report obvious transport damage to the carrier and to us at hello@theralpine.com as soon as possible, ideally with photos. Please also note visible damage to the packaging on the carrier's delivery receipt. This allows us to pursue our claims against the carrier. Your statutory rights remain unaffected. For deliveries to Switzerland, obvious defects and transport damage must be reported immediately under Art. 201 of the Swiss Code of Obligations, at the latest within 48 hours of receipt; otherwise the goods are deemed accepted with regard to these defects.

9. Warranty and guarantee

9.1 The statutory warranty rights apply, with the statutory conditions and time limits. For consumers, the warranty period is two years from delivery. Please report defects as soon as possible after discovering them at hello@theralpine.com.

9.2 For business customers, claims for defects become time-barred one year after delivery. This does not apply to claims for damages for injury to life, body or health, to claims based on intent or gross negligence, to fraudulently concealed defects, where a guarantee has been given, or to claims under the statutory rules on supplier recourse.

9.3 For defects in chillers, we ask you to take part in a remote diagnosis before returning the unit, for example with photos, videos or displayed error messages. This often solves a problem faster.

9.4 Any additional guarantee we grant is governed by the guarantee terms in the annex to these Terms. It does not affect your statutory rights.

10. Liability

10.1 Towards consumers, our liability is governed by statute.

10.2 Towards business customers, we are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law, for fraudulently concealed defects, and to the extent of any guarantee we have given. In cases of slight negligence, we are liable towards business customers only for the breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the contracting party may regularly rely; in this case, our liability is limited to the foreseeable damage typical for the contract. Otherwise, our liability towards business customers for slight negligence is excluded.

10.3 The limitations in clause 10.2 also apply to our employees, representatives and agents.

11. Safety and health notes

11.1 Please follow the operating manual and safety instructions supplied with every product and available on theralpine.com.

11.2 Our products are not medical devices. Cold therapy is not suitable for everyone. If you have health conditions, are pregnant or are unsure whether cold therapy is suitable for you, please consult a doctor before use. Cold therapy does not replace medical treatment; we make no healing claims. Your statutory rights and clause 10 remain unaffected.

11.3 Please place the tub on a level surface with sufficient load-bearing capacity; filled and in use, it weighs around 300 to 400 kg depending on the fill level. Keep this in mind in particular on balconies and roof terraces, and choose a location where escaping water cannot cause damage. Connect chillers only as described in the operating manual to a properly installed socket protected by a residual-current device (RCD). If these instructions are not followed, this may be taken into account as contributory negligence in the event of damage.

12. Use of the website and reviews

12.1 All content on theralpine.com, in particular texts, images, videos, trademarks and logos, is protected. Any use beyond private viewing and saving or printing for your own records requires our consent.

12.2 If you submit a review, it must be based on your own experience, be truthful and must not contain unlawful, offensive or promotional content. You grant us the non-exclusive, royalty-free right to publish your review on our channels. We reserve the right to remove reviews that violate these rules and to respond to reviews publicly.

13. Data protection

Information on how we process your personal data is set out in our privacy policy on theralpine.com.

14. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have questions or complaints, you can reach us at any time at hello@theralpine.com.

15. Governing law and jurisdiction

15.1 Contracts with Theralpine AG are governed by Swiss law, contracts with THERALPINE LLP by the law of England and Wales, in each case excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in Liechtenstein, contracts with Theralpine AG are governed by Liechtenstein law.

15.2 If you are a consumer, you retain the protection of the mandatory provisions of the law of the country in which you have your habitual residence. For claims by and against consumers, the statutory places of jurisdiction apply.

15.3 If you are a business customer, the place of jurisdiction for all disputes arising from the contract is the registered office of your contracting party, which is Freienbach, Switzerland, for Theralpine AG and London, United Kingdom, for THERALPINE LLP.

16. Final provisions

16.1 If any provision of these Terms is invalid, the validity of the remaining provisions remains unaffected.

16.2 We may change these Terms for future orders. Your order is governed by the version valid at the time of your order.

Annex: Guarantee terms

At Theralpine, we stand behind the quality and durability of our products. All Theralpine products bought through theralpine.com are covered by a two-year guarantee from the date of delivery. In addition to this guarantee, you have statutory rights against your seller in case of defects. Exercising those rights is free of charge, and they are not restricted by this guarantee.

What's Covered

This guarantee applies to the original purchaser and covers:

  • Manufacturing defects in materials or workmanship
  • Structural components of the ice bath tub
  • Internal parts of electronic components, where applicable (e.g. chillers)
What's Not Covered

This guarantee does not cover:

  • Normal wear and tear (e.g. filters, hoses, seals, gaskets)
  • Minor cosmetic variations caused by the rotational molding process
  • Scratches, discoloration, or other signs of use that occur after installation
  • Damage caused by misuse, negligence, improper installation, freezing, commercial use, or modifications
  • Improper storage or failure to follow our care and safety guidelines
  • Use of chemicals, cleaning or disinfecting agents not approved in the operating manual
  • Use of non-original spare parts or filters, and repairs or interventions by third parties not commissioned by us
  • Damage caused by a faulty power supply or an improper electrical connection
Inspection Upon Delivery

Please inspect your order immediately upon delivery. If your product arrives damaged, please notify us within 48 hours of receipt by emailing hello@theralpine.com and providing:

  • Your order number
  • Description of the issue
  • Clear photos or video of the damage

Only a report within 48 hours allows us to claim the damage from the carrier and send you a replacement quickly.

How to Make a Guarantee Claim

To make a guarantee claim, contact our support team at hello@theralpine.com. For chillers, we ask you to take part in a remote diagnosis (photos, videos, error messages) before returning the unit. You'll be asked to provide:

  • Proof of purchase (e.g. order confirmation or receipt)
  • Description of the issue
  • Photo and/or video evidence
Resolution Process

For a defect covered by this guarantee, we provide free of charge:

  • Repair, where possible
  • Replacement of parts or of the full unit

We offer a partial or full refund only as an optional alternative that you may accept. We expressly agree in advance any chargeable inspection or transport service outside your statutory or contractual entitlements. We bear the costs of repair or replacement under this guarantee, including transport.

Chillers

Chiller Pro and Chiller Lite units are covered by this guarantee. Normal wear of filters, hoses and seals is excluded from the guarantee.

Non-Transferable

This guarantee is valid only for the original purchaser and is not transferable to subsequent owners.

Legal Notice

The guarantor is your contracting party: for deliveries to Switzerland or Liechtenstein, Theralpine AG, Wolleraustrasse 41a, 8807 Freienbach, Switzerland; for deliveries to all other countries, THERALPINE LLP, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. The guarantee applies to products delivered to the countries listed in our shipping policy. These guarantee terms are also an annex to our Terms, which you receive as a PDF with the order confirmation.

Please report defects as soon as possible after discovering them at hello@theralpine.com. In some countries, for example Switzerland, a late notice of defects can put your claims at risk.
