Controllers. This Privacy Notice applies to two affiliated companies of the Theralpine group. The controller is

  • Theralpine AG, Wolleraustrasse 41a, 8807 Freienbach, Switzerland, for orders delivered to Switzerland or Liechtenstein, including contract handling, delivery, invoicing and customer service for these orders;
  • THERALPINE LLP, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, for operating this website, marketing and newsletters, the Theralpine App, and orders delivered to all other countries.

Each company is an independent controller. They share personal information with each other where necessary to process your order and provide customer service (Art. 6(1)(b) GDPR), where there is a legitimate interest in intra-group administration (Art. 6(1)(f) GDPR), and with your consent for marketing (Art. 6(1)(a) GDPR). Shared customer service (e-mail, phone, withdrawal form) is provided by THERALPINE LLP on behalf of Theralpine AG as processor under an agreement pursuant to Art. 28 GDPR.

This Privacy Notice of Theralpine AG and THERALPINE LLP (“we,” “us,” or “our”), describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use our services (“Services”), including when you:

  • Visit our website at https://theralpine.com or any website of ours that links to this Privacy Notice
  • Use the Theralpine App to control a Theralpine chiller
  • Engage with us in other related ways, including any sales, marketing, or events

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you place an order, request a quote, fill in our contact form, subscribe to our newsletter, submit our withdrawal form, leave a product review, or otherwise contact us (for example by email, phone, or WhatsApp).

The personal information we collect may include:

  • name, email address, and phone number
  • shipping and billing address
  • order details (products, order number, order value)
  • the content of your messages to us (for example a support request or a return reason)
  • newsletter and marketing preferences
  • where you use one of our advertising landing pages: your answers to optional qualifying questions (for example product interest or timeframe)

Payment Data. Payments are processed by Shopify Payments (major credit and debit cards as well as Shop Pay, Apple Pay, Google Pay and, in Switzerland, TWINT), where offered by Klarna, and by bank transfer for quote orders. We do not receive or store your full payment card details; we only receive confirmation of your payment and the information needed to fulfil your order. Sensitive Information. We do not ask for sensitive information.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information. Information required for an order is marked during checkout; without it, we cannot process the order. Newsletter subscriptions, marketing consent and information marked as optional are voluntary.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and browser and device characteristics, is collected automatically when you visit our website.

We automatically collect certain information when you visit, use, or navigate our website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preference, referring URLs, country, and information about how and when you use our website. We use your IP address to determine your approximate country so we can show you the correct currency, shipping options, and language. This information is primarily needed to maintain the security and operation of our website, and for the analytics and advertising described in Section 5, which run only with your consent where consent is required.

Like many businesses, we also collect information through cookies and similar technologies. Details of every tool we use, and how you can withdraw your consent, are set out in Section 5 below.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time. For more information, see “WHAT ARE YOUR PRIVACY RIGHTS?” below.
  • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more. For more information, see Section 5 of this Privacy Notice.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
  • To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

 

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

The General Data Protection Regulation (GDPR), the UK GDPR and, for Theralpine AG, the Swiss Federal Act on Data Protection (FADP) require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent. We use analytics and advertising tools (Section 5) only with your consent (Art. 6(1)(a) GDPR). For Theralpine AG, the processing principles of the Swiss FADP also apply.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
    • Ensure the secure operation of our website and systems and prevent fraud
    • Establish, exercise or defend legal claims
    • Administer our group of companies internally
    • Inform existing customers by e-mail about similar products of ours where the law permits this without consent and you have not objected
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

 

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share personal information only in the situations described in this section and with the following categories of recipients.

We share your data with third-party service providers ("processors") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our processors, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it, and they will not share your personal information with any organization apart from us.

The recipients we share personal information with are:

  • E-commerce platform: Shopify (store infrastructure and checkout)
  • Affiliated companies: Theralpine AG and THERALPINE LLP, as described under "Controllers" above
  • Fulfilment and logistics: our warehouse partners in the EU and in Switzerland and shipping carriers (for example DHL and Swiss freight and parcel carriers), who receive your name, delivery address, email address, and phone number to deliver your order
  • Payment processors: Shopify Payments (in Switzerland including TWINT) and, where offered, Klarna
  • Email and marketing services: Klaviyo (newsletter and marketing emails), Resend (transactional emails such as contact and withdrawal confirmations), Microsoft 365 (our mailbox)
  • Analytics and advertising services: the tools listed in Section 5 (Google, Meta, Microsoft Clarity)
  • Review platform: Loox (product reviews)
  • Hosting and infrastructure: Vercel (website hosting), Stape (server-side tagging infrastructure)
  • Professional advisers and authorities: accountants, tax advisers, and lawyers, as well as public authorities where we are legally required to disclose information
  • Chiller app services: Supabase (sign in for the Theralpine App), Hetzner (hosting of our own chiller service), Tuya (the connection between the app and your chiller), Apple (notifications and weather), and the Norwegian Meteorological Institute and Open-Meteo (weather forecasts, which receive rounded coordinates only). See Section 15.

We may also need to share your personal information in the following situation:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: Yes. We use cookies and, with your consent, analytics and advertising tools. You can change or withdraw your consent at any time via the "Cookie preferences" link in the website footer.

When you first visit our website, our consent banner asks which categories of cookies and similar technologies you allow. Analytics and advertising tools that store cookies or similar identifiers on your device run only after you have given the corresponding consent. You can change or withdraw your consent at any time via the "Cookie preferences" link in the website footer.

Consent management: Cookiebot

We use Cookiebot by Usercentrics A/S (Denmark) to obtain and document your cookie consent. Cookiebot processes your IP address and your consent choice in order to provide proof of consent, and stores your choice in a cookie (typically for 12 months). Your consent choice is also passed on to our Shopify checkout so that it is respected throughout your purchase.

Tag management and server-side tracking

We use Google Tag Manager to manage the measurement tools below, together with a server-side tagging infrastructure (operated by Stape) that runs on our own subdomain. Certain events, such as a completed purchase or a submitted lead form, may also be transmitted to the services below via this server infrastructure rather than directly from your browser. These events serve conversion measurement, that is, measuring whether our advertising leads to inquiries and purchases.

Google Analytics 4

We use Google Analytics 4 (Google Ireland Ltd. and Google LLC, USA) to understand how our website is used (pages visited, actions taken, approximate location). We have configured Google Consent Mode so that no analytics identifiers are stored without your consent. To opt out beyond our banner, you can also use Google's browser add-on at https://tools.google.com/dlpage/gaoptout.

Google Ads

We use Google Ads conversion tracking and remarketing (Google Ireland Ltd. and Google LLC, USA). When you reach our website through a Google ad, a click identifier may be stored and, if you later make a purchase or send an inquiry, reported to Google together with the order value so we can measure the effectiveness of our advertising.

Meta Pixel and Conversions API

We use the Meta Pixel and the Meta Conversions API (Meta Platforms Ireland Ltd. and Meta Platforms, Inc., USA) to measure the effectiveness of our advertising on Facebook and Instagram and to build advertising audiences. With your consent, the pixel stores cookies in your browser. Purchase and lead events may also be transmitted server-side together with contact details in hashed (pseudonymized) form to improve measurement accuracy. Meta also processes this data under its own responsibility; details are available in Meta's privacy policy at https://www.facebook.com/privacy/policy/. Your consent to advertising measurement applies equally to browser-side and server-side transmissions; you can withdraw it at any time via the cookie settings.

Microsoft Clarity

We use Microsoft Clarity (Microsoft Ireland Operations Ltd. and Microsoft Corporation, USA) to create session replays and heat maps (mouse movements, clicks, scrolling) that help us understand and improve how our website is used. Clarity runs only after you have consented to statistics cookies. If you submit a form containing your email address, we link your session to that email address for support and quality purposes. This only happens if you have accepted statistics cookies.

Klaviyo

We use Klaviyo (Klaviyo, Inc., USA) to send our newsletter and marketing emails, only if you have signed up for them. We store your email address, name, phone number (if provided), language, country, and how you found us (for example the campaign or page through which you signed up) in order to personalize content, and we may send you reminders such as a note about an incomplete order. Every email contains an unsubscribe link.

Loox

We use Loox (Loox App Ltd., Israel) to collect and display verified product reviews. When you view a page containing reviews, your browser connects to Loox servers, which process your IP address to deliver the widget. After a purchase, we send you an e-mail inviting you to review your product. The legal basis is our legitimate interest in customer feedback (Art. 6(1)(f) GDPR). You can object at any time, for example via the link in the e-mail or at hello@theralpine.com.

Vercel

Our website is hosted by Vercel (Vercel Inc., USA). Vercel processes IP addresses in server logs as technically required to deliver the website, determines your approximate country for the correct currency and shipping options, and collects aggregated performance measurements (page speed) that help us keep the website fast.

Resend

We use Resend (Resend, Inc., USA) to deliver transactional emails, for example the confirmation you receive after submitting our contact or withdrawal form. Resend processes the recipient address and the message content for delivery purposes only.

YouTube videos

Videos on our website are embedded in YouTube's privacy-enhanced mode and load only after you click the play button. Until you click, no data is transmitted to YouTube (Google). When you play a video, YouTube processes your IP address and device information under its own privacy policy.

6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: Some of our service providers process data outside the United Kingdom and the European Economic Area. We use recognized safeguards for these transfers.

THERALPINE LLP is based in the United Kingdom and Theralpine AG in Switzerland. Switzerland, the United Kingdom and the EEA states mutually recognize an adequate level of data protection, so transfers between them are permitted without additional safeguards. For transfers from Switzerland to other countries, we rely on the adequacy decisions of the Swiss Federal Council or on the safeguards described below. Our website is operated from the United Kingdom and the European Economic Area (EEA). Some of our service providers process personal data in other countries, in particular the United States (Google, Meta, Microsoft, Klaviyo, Vercel, Resend, Supabase, Apple), Canada (Shopify), Israel (Loox), and China (Tuya, which connects the Theralpine App to your chiller).

For the United Kingdom, Canada, and Israel, the European Commission has issued adequacy decisions confirming an adequate level of data protection. Transfers to providers in the United States are protected by the EU-U.S. Data Privacy Framework (including the UK Extension and the Swiss-U.S. Data Privacy Framework) where the provider is certified, and otherwise by the European Commission's Standard Contractual Clauses. Tuya, which is independently verified for GDPR compliance, applies the European Commission's Standard Contractual Clauses to transfers to China. For transfers from the United Kingdom we additionally use the UK Addendum to the Standard Contractual Clauses or the IDTA, and for transfers from Switzerland the Standard Contractual Clauses with the adaptations recognized by the FDPIC. You can request further details about these safeguards using the contact details in Section 13.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary for the purposes described in this Privacy Notice, unless the law requires a longer period.

Typical retention periods are:

  • Order, invoice, and tax records: up to 10 years, as required by tax and commercial law (including EU VAT rules)
  • Correspondence (contact form, email, withdrawal requests): as long as needed to handle your request, and afterwards up to 6 years where relevant to potential legal claims
  • Newsletter and marketing data: until you unsubscribe or object; proof of your earlier consent may be retained afterwards as required by law
  • Analytics and advertising data: Google Analytics stores event data for a maximum of 14 months; Microsoft Clarity session recordings are deleted after approximately 30 days and aggregated Clarity reports after a maximum of 13 months. The storage period of each cookie is listed in the cookie settings on our website. After you withdraw your consent, no new data is collected.
  • Theralpine App data: for as long as you have an account; technical logs about your chiller for 90 days. See Section 15.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services cannot be made completely risk-free. Our statutory data protection obligations and your statutory rights remain unaffected.

 

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at hello@theralpine.com.

 

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In the EEA, the United Kingdom, and Switzerland, you have rights that give you access to and control over your personal information.

Under applicable data protection law, you have the right (i) to request access to and obtain a copy of your personal information, (ii) to request rectification or erasure, (iii) to restrict the processing of your personal information, (iv) to data portability where applicable, and (v) to object to processing based on legitimate interests, including profiling for direct marketing. To exercise any of these rights, contact us at hello@theralpine.com. We will consider and act upon any request in accordance with applicable data protection laws.

If you believe we are unlawfully processing your personal information, you also have the right to complain to a supervisory authority: in the EEA, the data protection authority of your country of residence (in Liechtenstein, the Data Protection Authority); in the United Kingdom, the Information Commissioner's Office (ICO); and in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC).

Complaints to us: You can also complain directly to the responsible company about an infringement of your data protection rights, by e-mail to hello@theralpine.com or at the postal address in Section 13. Where the UK GDPR applies, we acknowledge receipt within 30 days, investigate without undue delay and inform you of progress and the outcome. Your right to complain to a supervisory authority remains unaffected.

Withdrawing your consent: Where we rely on your consent to process your personal information, you can withdraw it at any time with effect for the future. For cookies and tracking technologies, use the "Cookie preferences" link in the website footer. Withdrawal does not affect the lawfulness of processing before the withdrawal.

Opting out of marketing: You can unsubscribe from our marketing emails at any time by clicking the unsubscribe link in any email we send or by contacting us. We may still send you service-related messages, for example order confirmations, that are necessary for the performance of your contract.

Automated decision-making: We do not use automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

 

12. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated “Revised” date at the top of this Privacy Notice. If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.

14. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, details about how we have processed it, correct inaccuracies, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. 15. THE THERALPINE APP AND YOUR CHILLER

In Short: If you use the Theralpine App to control a chiller, we process your account, the profiles you create, what your chiller reports to us, your plunge sessions and, if you switch on the weather features, the location of your chiller. Nothing from the app is used for advertising, and nothing is sold or shared with data brokers.

What the app collects

  • Your account: your email address and a password. The password goes directly from your phone to our authentication provider; we never see or store it.
  • Your household: the names of the profiles you create and, if you add them, their profile pictures.
  • Your chiller: what the machine reports, such as the water temperature, whether the compressor or the pump is running and any error state, together with the schedules, modes and water care settings you choose.
  • Your sessions: when you plunged, how cold the water was, how long you stayed in, how it felt if you say so, any note you write, and a photo if you attach one.
  • The location of your chiller, only if you enable the weather-based features. Your phone sends the coordinates when you enable them, and our server rounds them to about one kilometer before storing them. We do not track your phone and we keep no location history.
  • A notification token from Apple, so that your chiller can reach your phone.
  • During setup, the name and password of your Wi-Fi network are passed to the chiller so it can join your network. We do not receive or store them.

Tuya's software inside the app also collects technical information about your phone in order to keep the connection working: device model, operating system version, app version, a push identifier and your IP address. Your Tuya user identifier, which we create for you and which contains no personal details, is used by Tuya for its own service analytics.

Why, and on what legal basis

We process your account, your chiller's data, your schedules and your sessions to provide the app you asked us for, which is the performance of our contract with you (Art. 6(1)(b) GDPR). Location and photos are processed on the basis of the permission you grant in iOS, which you can withdraw at any time in your iPhone's settings (Art. 6(1)(a)). Our server keeps a technical log of the commands sent to your chiller and the reports it returned, to find faults and to protect the machine, which is our legitimate interest (Art. 6(1)(f)). That log is kept for 90 days and is not used for anything else.

Who processes it for us

  • Supabase (Supabase Inc., United States) provides sign in; the database for this project is located in Frankfurt, Germany.
  • Hetzner Online GmbH (Falkenstein, Germany) hosts our own service, where your chiller data, schedules, sessions and photos live.
  • Tuya (Hangzhou Tuya Information Technology Co., Ltd. and its affiliates, China) provides the connection between your chiller and the app. The account and the chiller created for you through our app are held in Tuya's Western Europe data center. Because Tuya is a Chinese company, this is a transfer to a country without an adequacy decision. Tuya is independently verified for GDPR compliance and applies the European Commission's Standard Contractual Clauses to such transfers.
  • Apple (Apple Inc., United States) delivers notifications and, where we use it, the weather forecast.
  • The Norwegian Meteorological Institute (Norway) and Open-Meteo (Germany) supply weather forecasts for the frost features. They receive only the rounded coordinates, nothing that identifies you.
  • Resend (United States) sends the emails the app needs, such as the code that confirms your address.

How long we keep it

For as long as you have an account. Deleting your account in the app removes your login, your profiles, your sessions with their notes and photos, your schedules, and the notification token, and it deletes the Tuya account we created for you. Your chillers are released from the account; they are not reset, so you can pair them again. Technical logs about the machine itself, which do not name you, are kept for 90 days.

Your choices in the app

You can export the data the app holds about you, and delete your account, from your account settings in the app. You can revoke the location, camera, photo, Bluetooth, local network and notification permissions at any time in iOS settings. Revoking a permission stops the feature that depends on it; it never disables your chiller, which keeps running on its own.
